Trademark Registration

Your brand name, logo, and tagline are among your most valuable business assets. Our Trademark Registration service helps you secure exclusive legal rights over your brand identity, protecting it from imitation and unauthorized use across India.

Whether you are a startup filing your first trademark, an established business expanding your brand portfolio, or someone responding to a trademark objection, our team offers end-to-end guidance backed by practical experience with the Indian Trademark Registry.

A trademark is more than a legal formality — it is the foundation of how customers recognize, trust, and choose your business over competitors. Once registered, it grants you exclusive nationwide rights to your mark, legal standing to act against infringers, and a valuable intangible asset that can be licensed, franchised, or transferred as your business grows.

Trademark filing in India is fully digital, administered through the Controller General of Patents, Designs and Trademarks (CGPDTM) under the Ministry of Commerce and Industry. While the online portal has made the process more accessible, correctly classifying goods and services, drafting the application, and responding to examiner queries still requires experienced handling — which is where our team steps in to keep your filing on track from search to certificate.

Benefits of Trademark Registration

Registering your trademark is one of the most cost-effective ways to safeguard your brand's long-term value. Here's what you gain once your mark is officially registered with the Indian Trademark Registry.

01

Exclusive Legal Ownership

Registration gives you the sole right to use your mark for the goods or services it covers, anywhere in India.

02

Legal Protection Against Infringement

A registered mark lets you take civil and criminal action against anyone who copies or misuses your brand.

03

Reduces Confusion & Disputes

A registered mark makes ownership clear, lowering the chance of consumer confusion and costly disputes with similar brands.

04

Builds Brand Trust & Value

A registered ® mark signals credibility to customers, investors, and partners, and adds measurable value to your business.

05

Asset for Growth

Your trademark can be licensed, franchised, or sold, turning your brand identity into a source of additional revenue.

06

Foundation for Global Filing

An Indian registration can support future trademark applications abroad through international treaty routes as you expand.

Who Can Apply for Trademark Registration?

Trademark registration in India is open to a wide range of applicants. Whether you operate as an individual or a registered entity, our team helps you file correctly under the applicable category.

Individuals

Freelancers, consultants, and solo entrepreneurs can register a mark in their own name.

Startups & MSMEs

Recognized startups and MSMEs are eligible for a discounted government filing fee.

Partnerships & LLPs

Registered partnership firms and LLPs can file jointly in the business's name.

Companies

Private and public companies of any size can protect their products, services, and sub-brands.

Beyond who can apply, the mark itself must qualify. It needs to be distinctive enough to set your goods or services apart, and it cannot be purely descriptive, generic, deceptive, or identical to an existing registered or pending mark. Your goods and services also need to be classified correctly under the Nice Classification system's 45 classes — this is one of the most common places applicants go wrong, and one of the first things we check during search.

Trademark Objection vs Trademark Opposition

These two terms are often confused, but they happen at different stages of the registration journey and need different responses.

Trademark Objection

Raised by the Registry's examiner during initial review, usually over descriptiveness, similarity to an existing mark, or missing documentation. We file a written reply within the deadline to move your application past this stage.

VS

Trademark Opposition

Filed by a third party after your mark is published in the official journal, typically citing prior rights or likely confusion. We prepare your counter-statement and evidence, and represent you through the hearing.

How to Track Your Trademark Application

Once filed, you can check your application status anytime on the official IP India portal. We also keep you updated at every milestone, but here's how to check it yourself:

1

Visit the IP India Portal

Go to the official government trademark portal and log in, or register as a new user if you haven't already.

2

Open "My Portfolio"

Select "View Your Applications/Registrations" to see every mark filed under your account.

3

Check Status & Reports

Click your application number to view examination reports, opposition status, hearing dates, and certificate details. You can also use the public "Trademark Status" search without logging in.

Frequently Asked Questions

A trademark typically takes 8 to 18 months to register if there are no objections or oppositions. Once filed, you can use the TM symbol immediately; the ® symbol is used only after registration is granted.

You will need the applicant's identity and address proof, a clear image of the logo or wordmark, business registration proof (if applying as a company or LLP), and a signed Power of Attorney (Form TM-48) authorizing us to file on your behalf.

An objection is common and not a rejection. It means the examiner has raised a query, usually about similarity to an existing mark or descriptiveness. We draft and file a written response within the prescribed timeline to keep your application moving forward.

A registered trademark is valid for 10 years from the date of filing. It can be renewed indefinitely for further periods of 10 years each, as long as renewal applications are filed on time.

Yes. Whether you are opposing someone else's application or defending your own mark against an opposition, our team prepares the counter-statement, evidence, and represents you through the entire opposition proceeding.

TM indicates an unregistered trademark claim and can be used as soon as you file. ® can only be used once the mark is officially registered. © applies to original creative works such as content, artwork, or software, and is a separate right from trademark protection.

The government filing fee is ₹4,500 per class for individuals, startups, and MSMEs, and ₹9,000 per class for other entities. Professional fees vary depending on the scope of search, drafting, and follow-up required, and we provide a transparent quote before you commit.

Yes. India allows "proposed to be used" applications, so you can secure your filing date before launch. You will need to declare a genuine intention to use the mark, and it's advisable to start using it within a reasonable period after registration.

Yes, anytime. You can log in to the official IP India portal and view your application under "My Portfolio," or use the public status search without logging in. We also proactively notify you whenever there's a status change.
